Judgment
THIS case has come up for hearing before us on a number of occasions previously. The Opposite Parties have remained absent in spite of their having been duly served notices intimating them about the posting of the case.
HENCE a petition was filed by the Complainants requesting for ex-parte decision of the complaint and on that petition an Order was passed by this Commission on 28.1.1994 directing the original complaint to be posted expeditiously. It is accordingly posted today. When the case was taken up for hearing today Mr. Amrit Pal Singh, Advocate who has now filed appearance on behalf of the Opposite Party No. 2 prayed for the grant of short time for filing a written statement Opposite Party No. l still remaining absent and he is hereby set ex-parte. As regards the request of Opposite Party No. 2 for permission to file a written statement at this highly belated stage we consider that he can be granted such permission only on terms as to payment of costs. We direct that the Opposite Party No. 2 shall pay a sum of Rs. 3,000/- by way of costs to the Complainants within a period of two weeks from today. On compliance with the said condition the Opposite Party No. 2 will be permitted to file its written statement within three weeks from today. Post this petition on 28th July, 1994.
