This is an assigned matter by virtue of the order dated 25th January 2018 passed by Hon'ble the Acting Chief Justice on the administrative side.
The petitioner is aggrieved of the declaration of the result for the post of Mukhiya of Suriya Khurd Panchayat in favour of Balgovind Mandal.
Mr. Suresh Kumar, the learned counsel for the petitioner submits that during pendency of this writ petition the writ petitioner has passed away.
Mr. Sumeet Gadodia, the learned counsel for the State Election Commission has drawn attention of the Court to section 155 of the Jharkhand Panchayat Raj Act, 2001.
Section 155 of the Jharkhand Panchayat Raj Act, 2001 reads as under:
“Order as to corrupt practices-
The corrupt practices referred to under this Act shall entail disqualification for membership of any local authority for a period of 5 years counting from the date on which the finding of the prescribed authority as to such practices takes effect under this Act.”
While so, the present writ petition is dismissed as abated.
