By way of the present petition the petitioner, inter alia, claims striking out the selection related procedure through draw of lots envisaged in sub

paragraph ''P'' of Paragraph 18 of the Manual for selection of Dealers for regular and Rural Outlets (Annexure-4). The petitioner has also prayed

for quashing of selection process held on 26th December, 2016 for selecting the Retail outlet dealearship for at ""Between KM Stone 31 to KM 33

on NH 40 on RHS in increasing Chainage"" under Ri-Bhoi District in connection with advertisement dated 05th November, 2014 2. The

respondents have filed affidavit-in-opposition.

Mr. B.K. Deb Roy, learned counsel for the petitioner submits that the petitioner does not want to pursue the present petition and seeks

permission to withdraw the present petition with liberty to file fresh petition if occasion so arises. Learned counsel for the petitioner further submits

that an application for withdrawal of the present petition being Misc. application No. 159 of 2017 has been filed.

Mr. K. Paul, learned counsel for respondent No. 1 and Mr. N. Mozika, learned counsel for the respondent No. 4 have no objection to the

prayer made by learned counsel for the petitioner.

In view of the facts and circumstances of the case and submissions made by learned counsel for the parties as well as the application bearing

Misc. Case No. 159 of 2017, the present petition is dismissed as withdrawn with the liberty aforesaid.

The writ petition and Misc. Case No. 159 of 2017 stand disposed of.

Misc. Case No. 118 of 2107 Misc Case No. 41 of 2017 Both the applications are dismissed being infructuous.
