R.S. Mongia and S.C. Datta, JJ.—Petitioner''s father, who was working in the Life Insurance Corporation of India (in short ''the Corporation'') unfortunately died on December 4, 1982, while in service. The mother of the petitioner at that time was working in the High Court and presently she is working as Senior Assistant. As per the instructions of the Corporation, with which we dealt with in an earlier case in C.W.P. No. 14819 of 1994, decided on February 13, 1995, ( Nirmal Arora Vs. Life Insurance Corporation of India and Others, if a member of the family of the deceased is already gainfully employed in the Corporation or somewhere else, the other members of the family are not entitled to be considered for appointment in the Corporation on compassionate ground. Since at the time of the death and even now the wife of the deceased was and is working in the High Court, as observed above, the petitioner would not be entitled to be considered for appointment in the Corporation on compassionate ground in accordance with the instructions on the subject issued by the Corporation. Moreover, from the instructions, we find that where all the children of the deceased are minors, the case of appointment on compassionate ground can only be considered upto three years from the date of death of the deceased employee of the Corporation. In the present case, as observed above, petitioner''s father died on December 4, 1982, whereas the application for appointment on compassionate ground was made on September 10, 1994. Consequently we do not find any merit in this petition and the same is hereby dismissed.
