Judgment
ORDER
Per Hon’ble Mr. M.S.Latif, Member (Judl.):- The petitioners through the medium of the instant O.A. have sought for a direction upon the respondents to settle whatever pensionary benefits/service benefits have accrued in favour of the petitioners, the same be released in their favour in accordance with their entitlement and rules.
The short grievance projected by the petitioners is that Mohammad Ashraf Lone S/O Ghulam Mohammad Lone R/O Kultoora Langate Handwara District Kupwara, who happened to be the husband of the petitioner no. 1 and father of petitioner no. 2, expired on 17-01-2024 in SKIMS Soura Srinagar while in service.
Learned counsel for the petitioners submits that the deceased was a F.A. Teacher in the Education Department. He has also referred to his service record duly attested by the Zonal Education Officer, Handwara wherein the deceased has been shown to have drawn Rs. 66,200/- as his last emoluments.
Learned counsel for the petitioners submits that the petitioners are entitled to the death cum other benefits to which the deceased was entitled to in terms of the law and the rules. He submits that the respondents are sitting over the disposal of the representations filed by the petitioners from time to time.
Learned counsel further submits that the petitioners have already represented before the respondents to which he has referred to Page 35, 36, 37 and 38 of the O.A. He further submits that he would be satisfied if a direction is issued upon the respondents to take a decision upon the representations filed by the petitioners from time to time.
Heard learned counsel for the parties.
At the request, the petition is disposed of by providing that the respondents will take a decision on the representations filed by the petitioners from time to time reportedly pending before the respondents. While disposing of the petition, the respondents to also consider the averments as contained in O.A. along with all annexures. It is expected that the respondents, keeping in view the peculiar facts and circumstances of the case, will expedite the disposal by passing a speaking and reasoned order in terms of the law.
With this O.A./273/2024 is disposed of accordingly.
