Judgment
Rajiv Sharma, J.—The Petitioner filed a writ petition in the year 1996 which was allowed by means of judgment and order dated 25.8.2010 commanding the opposite parties to accord pension to the Petitioners with the condition that the Contributory Provident Fund, which has been received by the Petitioner, would be returned back by him on the demand of the Corporation. A copy of the judgment and order passed in Writ Petition has been served upon the opposite parties on 7.9.2010. Learned Counsel for the Applicant submits that the copy of the judgment and order was assailed in Special Appeal by the Corporation, but it was dismissed vide order dated 29.11.2010. Thereafter, the Petitioner submitted an application on 10.12.2010 alongwith a copy of the certified copy of the judgment and order dated 29.11.2010 passed in Special Appeal No. 813 of 2010.
According to the Petitioner, till date, the order of Writ Court has not been complied with.
As the Petitioner is 79 years old and the opposite parties are depriving him from payment of pension and arrears, let notice be issued to the opposite parties to show cause as to why action may not be taken under the Contempt of Courts Act for wilful disobedience of the order dated 25.8.2010 passed in Writ Petition No. 7728 (SS) of 1996 and order dated 29.11.2010 passed in Special Appeal No. 813 of 2010.
List on 14.3.2011 on which date both shall appear in person alongwith their respective replies.
