Judgment
THE House Building Society of Ministry of Commerce & Industry, Pushpanjali Enclave, Pitampura, Delhi, through its President, Shri J.K. Dogra and Secretary, Shri R.D. Sharma alleged that inspite of the deposit of the required amount for providing various specific facilities, the Municipal Corporation of Delhi has not done the work, which they were required to do so, in a reasonable time, and thus causing inconvenience to the members of the Society, who have built their houses in this colony. Vide their letter No. TP/G/6339/90 dated 12th October, 1990 the Municipal Corporation of Delhi in the Town Planning Department had undertaken to do the work in respect of (a) construction of roads and storm water drains; (b) horticulture; (c) street lighting system; (d) water supply system; and (e) sewerage system on the request of the Pushpanjali Enclave, Pritampura, Delhi � belonging to the Ministry of Commerce and Industry House Building Society Ltd. However, till 18th November, 1993, after a period of three years from accepting the required work to be done by them and even after the deposit of a sum of Rs. 15,60,900/- towards deficiency charges in respect of roads and storm water drains no work was undertaken by them. The complainant Housing Building Society made a representation to the Municipal Corporation of Delhi, but to no avail. On .the issue of notice, the Municipal Corporation of Delhi filed their reply in the form of the following affidavits on December 8,1991: (1) Affidavit of Shri Ram Singh, Zonal Engineer (Works) M.C.D. (2) Affidavit of Shri Bhim Singh Yadav, Assistant Director of Horticulture, Rohini Zone, M.C.D., Delhi. (3) Affidavit of Shri R.S. Tyagi, Executive Engineer, Water, Sewer Line Zone, Delhi. (4) Affidavit of Shri Hari Mohinder Singh, Executive Engineer, M.C.D. (5) A letter dated 11th July, 1995 from Shri Hari Mohan Singh, Executive Engineer, (CAC) (VII) and a letter dated 15th July, 1995 from the same Executive Engineer.''
IN these affidavits and the letters, the Municipal Corporation of Delhi have stated that the required work in respect of the specific items of work under question have been completed. However, the complainants still had the grievance that quite a balance amount of work has not yet been completed. We have carefully perused the affidavits filed by these Officers and find that the grievance of the appellant Society has been substantially removed and, therefore, dispose of this Original Petition accordingly. We, however, expect that any minor works which might have been left in the process of completing the works for providing the roads, etc. will also be completed by the Municipal Corporation of Delhi so that no irritant is left between the Society and them. With these observations we dispose of this petition. The parties will bear their respective costs.
