The Appellant was directed to deposit a sum of Rs.2 crores as pre-deposit to entertain this Appeal. As per the order of this Tribunal dated 01.03.2024, on that date, a sum of Rs. 25 lakhs was paid by RTGS towards the aforesaid sum. The balance amount was directed to be deposited in two instalments. The 1st instalment of Rs.65 lakhs was to be deposited on or before 22.03.2024. Towards that amount, the Appellant deposited only Rs.40 lakhs and there is a balance of Rs.25 lakhs payable towards that instalment. The Appellant submits that because of the financial crunch, she was unable to deposit the entire payment towards the 1st instalment and therefore, seeks an extension. The prayer for extension is vehemently opposed by the Ld. Counsel appearing for the Respondent Bank stating that the Appellant has been seeking time for payment before D.R.T. as well, and therefore, no further indulgence may be shown. Considering the submission made by the Ld. Counsel for the Appellant of granting time to pay the balance amount of Rs.25 lakhs towards the 1st instalment, time is granted to pay the balance amount together with the 2nd instalment.
Interim order shall stand extended.
