The present writ petition has been filed by the petitioner for directing the respondent to release the pensionary benefits as also the leave salary of the petitioner.

During the pendency of the present petition, the petitioner died and vide order dated 11.05.2023, his LR’s, namely, Maya Devi, Ram Parshad, Darshan Kumar and Sohan Lal were impleaded as petitioners in his place.

Response stands filed by the respondent, wherein it has been stated that the petitioner attained superannuation on 31.07.2001. His pension case was forwarded to the Accountant General, which stands sanctioned and paid to the petitioner. It is further stated that the petitioner was also entitled to leave salary, but as there was recovery against the petitioner for an amount of Rs. 31,640/-, so the petitioner was directed to report in the Office of Traffic Manager (Load Fleet) for collection of balance leave salary i.e. Rs. 33,359/-.

In view of the categoric stand taken by the respondent that an amount of Rs. 33,359/- is the only amount due to the deceased petitioner, the present petition is disposed of with a direction to the petitioners (LRs of the deceased petitioner) to approach the Office of Traffic Manager (Load Fleet of J&K S.R.T.C) and in the event they approach the concerned officer, the balance leave salary for an amount of Rs. 33,359/- be released in their favour in accordance with law after their due identification and verification.
