Judgment
The Court : This is an application under Article 226 of the Constitution of India challenging orders dated 20th December, 2017 and 11th January, 2018
passed by the State Information Commissioner, West Bengal. The grievance of the petitioner is that on the date of first hearing being December 20,
2017 the petitioner was present but, the State Public Information Commissioner was not present. Subsequently, due to the absence of the State Public
Information Officer, the matter was adjourned to January 11, 2018. It is the submission of the petitioner that this order was never communicated to the
petitioner and he was not aware of the next date of hearing. On the next date of hearing the respondent Authority heard the matter and passed an
order ex parte recording therein that the appellant did not attend. It was the submission of the petitioner that there has been gross violence of the
natural justice as the respondent
Authority has passed orders on merit in his absence.
This matter is fixed on 17th April, 2018 for further hearing on the top.
The petitioner is directed to serve a copy of this order by tomorrow on the respondent Authorities and to file affidavit-of- service on that date.
