Where a co-sharer who had been given symbo lical possession in execution of a decree for joint possession under S. 264 of C. P. C., 1882 (O. 21, R. 36 of Code of 1908) sued for partition and separate possession, held, that he should be allowed mesne profits for a period of six years only prior to the suit.
The judgment delivered on 7th April, 1924, reported in the All India Reporter 1924, PC section, page 144, was subsequently amended by their Lord ships of the PC on 29th Octo ber, 1924 by inserting the date 8th August, 1906, in place of 20th June 1903 Vide A.I.R. 1924 P.C. 144 at 150 Col. 1, 14th line from top the suit having been tiled on 8th August, 1912.
