Judgment
This Appeal has been filed against the order dated 14.09.2022 passed by Adjudicating Authority (National Company Law Tribunal, New Delhi Bench, Court –II) by which I.A. 4322/2022 filed by the Appellant has been rejected. Appellant has filed the I.A. for rejection of Section 7 of the Application. Adjudicating Authority while rejecting the application has made following observation:
“Hence, we observe that at this stage, there is no ground for moving such an application. The Respondent can submit his contentions through his Reply in the main petition as well as during the arguments”.
In view of the above observations made by Adjudicating Authority that it is open for the Appellant to submit his contention through his Reply in the main Petition as well as during the arguments, the appellant rights are fully protected and it is open for the Appellant to raise all his objections at the time of hearing of the Section 7 Application.
This Appeal is dismissed with the above observations.
