ORDER
06.01.2023: Heard Learned Counsel for the parties.
This appeal has been filed against the order dated 01.12.2022 by which Interim Order was passed on IA No. 2108 of 2022 in C.P.(IB)/4334(MB)/2019.
Learned Counsel for Appellant submits that 'Consent Terms' has been entered between the parties on 05.01.2023 in accordance with which the Operational Creditor has agreed to withdraw the application filed under Section 9.
Learned Counsel for Operational Creditor submits that Operational Creditor has already filed the application to withdraw the Section 9 application.
The Section 9 application has not yet been admitted.
Learned Counsel for the Operational Creditor submits that they have no objection if order dated 01.12.2022 is vacated. We record the above statement of Learned Counsel for the Respondent.
It shall be open for the parties to approach the Adjudicating Authority for passing the appropriate order for withdrawal of the application.
We have permitted the Appellant to withdraw the appeal on his oral submission. With the above observations, the appeal is dismissed as withdrawn.
