Judgment
Rajesh Bindal, J.—The prayer in the present writ petition filed by the Metal Box Employees Union is that the dispute referred by the appropriate Government pertaining to the payment of amount settled by the Management of erstwhile M/s Metal Box India Limited, which has now been taken over by respondent no. 4, be transferred to any other court from Faridabad, as the members of the petitioner'' union are not able to pursue their case at Faridabad on account of various reasons. The finger of accusation is raised against respondent no. 4. The allegations made by Learned Counsel for the petitioner are denied by counsel for respondent no. 4.
Learned Counsel for the State submitted that after the dispute was referred to the Labour Court at Faridabad in September 2010, the proceedings are continuing.
Without recording any finding as regards the allegations made by the petitioner, but still considering the fact that the workers in the present case are claiming their dues in terms of settlement arrived at between the management, they deserve to be granted fair opportunity to plead their case, in my opinion, it would be in the interest of justice to transfer the reference from the Labour Court at Faridabad to Labour Court-I at Gurgaon.
The writ petition stands disposed of. Copy of this order be given dasti on payment of usual charges.
