Judgment
There is a typographical error in the order dated August 12, 2026.The same is hereby corrected by recording that the expression “not” in the second paragraph of the said order shall stand deleted.
Report filed on behalf of the WBSEDCL authority is taken on record.
The petitioner complains of inaction on the part of the respondent/WBSEDCL authority in effecting the electricity supply at the petitioner’s residential premises.
The WBSEDCL authorities submit that they are ready and willing to effect to supply in favour of the petitioner, but they could not do so in view of the objection raised by the private respondents.
The inspection report filed in Court today,reveals that the petitioner is in possession of the subject property. Since, the petitioner is in possession of the subject property, the petitioner is entitled to electricity supply in terms of Section 43 of the Electricity Act, 2003.
Mr. Kaushik Dey, learned advocate for the petitioner submits that the petitioner has already paid the quotation that was raised by the WBSEDCL authorities for the purpose of effecting electricity supply in favour of the petitioner.
In such view of the matter, WBSEDCL authorities are directed to effect supply in favour of the petitioner within two (2) weeks from the date of compliance of all further formalities, if any, by the petitioner.
If the WBSEDCL authority faces any objection or resistance at the instance of the private respondents and/or their men and agents, the WBSEDCL authorities will be entitled to approach the Officer-in-Charge, Jagacha Police Station, seeking police assistance. In case, the said Officer-in Charge is approached by the WBSEDCL authorities, the said Officer-in-Charge would afford adequate police assistance to the WBSEDCL authorities to enable them to effect supply in favour of the petitioner in terms of this order. Costs for such police assistance would be borne by the petitioner.
WPA 15628 of 2026 stands disposed of.
