Mehar Singh vs State of Punjab

Jaswant Singh.J.—Petitioner-Mehar Singh @ Bagga, who is facing trial in case FIR No. 634 dated 22.12.2003 under Sections 420, 380, 34 IPC, PS Sadar Jalandhar has approached this Court for grant of anticipatory bail to join the proceedings in view of his earlier bail bonds having been cancelled, due to his non-appearance on one date i.e. 12.7.2010.

Learned Counsel submits that the sole absence of the Petitioner on 12.7.2010 was due to wrong noting of the date as 12.9.2010. It is further submitted that the learned Additional Sessions Judge,Jalandhar had granted anticipatory bail to the Petitioner subject to his furnishing personal bond in the sum of Rs. 25,000/- each with one surety in the like amount each. It is submitted that Petitioner is constrained to approach this Court since he could not arrange the requisite surety of the said amount within the stipulated period of seven days. Prayer is for grant of one more opportunity on the same terms.

At the asking of the Court, Mrs.RK Nihalsinghwala, Addl.AG Punjab accepts notice and does not seriously contest the prayer.

In view of the facts noticed above, the present petition is disposed of with a direction that in case the Petitioner surrenders before the trial court within seven days from today, eh shall be admitted to bail on his furnishing personal bond in the sum of Rs. 25,000/-with one surety in the like amount to the satisfaction of the trial Court.
