Judgment
Heard learned counsel for respondent no. 2 and learned counsel for the petitioner in respect of preliminary issue raised on behalf of respondent no. 2 that it is not a necessary party hence, be deleted.
On a perusal of prayers and pleadings in the petition, it appears that not only relief has been sought against respondent no. 2 also but allegations have been made that respondent nos. 1 and 2 are in connivance and the properties of respondent no. 1 are with respondent no. 2 as well.
The pleadings are already complete and petitioner has filed its evidence. The respondents have been granted time on few days to file their evidence. That should be done within one month failing which right to file evidence shall stand closed. Liberty is granted to respondent no. 2 to raise the issue of wrong impleadment as a preliminary issue at the time of final hearing and the same shall be considered on its own merits in the light of pleadings and materials on record.
Post the matter before the Court of Registrar on 4.4.2022. The earlier date fixed for 15.3.2022 before the Court of Registrar shall stand modified.
