Judgment
This is a petition under Section-482 of the Code of Criminal Procedure, 1973 (Cr.P.C.) filed by the petitioner against the impugned order dated
22nd September, 2015 passed by District Magistrate, Ri-Bhoi District, Nongpoh in Executive Proceedings No. 2 of 2014 under Section-133
Cr.P.C.
Mr. N. Mozika, learned counsel for petitioner submits that District Magistrate has passed the order under Section-133 Cr.P.C. and the said
order is revisable. Learned counsel for petitioner seeks permission to withdraw the present petition with liberty to avail appropriate remedy.
Learned counsel for petitioner has also moved an application Misc. Case No. 2 of 2017 for withdrawal of the present petition with liberty to
avail appropriate forum.
Mr. N.D. Chullai, learned senior GA submits that he has no objection to the same.
In view of the facts and circumstances of the case and submission made by learned counsel for petitioner as well as Misc. Case No. 2 of 2017,
the present petition is dismissed as withdrawn. However, the petitioner is at liberty to avail appropriate remedy in accordance with law.
Lower court case record be sent back immediately.
