Heard Dr. N. Mozika, learned Senior counsel assisted by Mr. A.A. Khan, learned counsel for the appellant.
This appeal is directed against the order dated 22.05.2024, passed in Misc. Case No. 1 of 2020 arising out of T.S. No. 1 of 2018, by the Court of District Judge, Ri-Bhoi District, Nongpoh.
Dr. N. Mozika, learned Senior counsel assisted by Mr. A.A. Khan, learned counsel for the appellant submits that the appeal is primarily against the cost imposed upon the appellant, for the alleged breach of trademarks. He therefore prays that the matter be admitted for consideration, especially on the quantum.
Mr. B.D. Konwar, learned Senior counsel assisted by Mr. J. Singh, learned counsel for the respondent has vehemently objected to the prayer, and has submitted that if the matter is to be admitted for consideration, the appellant should at least deposit 50% of the cost amount, before the Registry of this Court.
Accordingly, as the matter deserves further consideration, Misc. Case No. 1 of 2020 is admitted for hearing, subject to payment of Rs. 1.50 Lakhs, to be deposited before the Registrar General, within 1(one) week.
Let the records of the Misc. Case be called. It is made clear that the proceedings in the main Title Suit shall continue.
