Meetu Kandpal vs State of U.P.& Ors.

Yatindra Singh, J.—Petitioner appeared in the High School examination in the year 1999 which was conducted by U.P. Board of High School and Intermediate Education, Allahabad (the Board). She was not satisfied with the marks awarded to her in Mathematics and Science. Consequently she filed ;a representation on 971999 when no oyster was passed therein, she filed the present writ petition.

I have heard Sri N.A. Khan, counsel for petitioner and standing counsel for the respondents. This Court by order dated 381999 had ordered for production of the relevant copies. The standing counsel has produced the relevant copies. The standing counsel has also given a statement that after the writ petition was filed the copies of the petitioner were scrutinized again. It was found that the answer given on left page were not examined and as such those questions were reexamined and petitioners marks were enhanced. Initially 46 marks out of 100 in MathematicsII and 63 marks out 100 in ScienceII subjects were awarded to the petitioner. After reexamination of the copies the petitioner has been awarded 64 marks out of 100 in MathematicsII and 63 out of 100 in ScienceII subjects. In view of this the Board is directed to issue a fresh markssheet to the petitioner in accordance with the enhanced marks. With these directions the writ petition is disposed of.
