Judgment
THIS petition arises out of execution proceedings taken against the petitioner and respondent Nos. 10 to 18 who were opposite parties in a complaint filed by respondent Nos. 3 to 9. Petition is directed against the two orders of the State Commission passed in EP 5 to EP 6 both of 1994 issuing warrants of arrest against the petitioner. Complaint filed by the respondent Nos. 3 to 9 was allowed by the State Commission by order dated 7.6.1994 and has assumed finality. Complaint was against M/s. Vijaya Credit Corporation, a partnership firm of which the petitioner and other respondents 11 to 18 were partners (respondent No. 10 is the firm itself). Various amounts were deposited by the complainants with the partnership firm which on maturity were not repaid. THIS led the complainant to file the complaint which was allowed by the State Commission.
COMPLAINTS were filed in 1993. Eight years have gone by; complainants have not been able to recover the amount till this date. They have been involved in various kinds of litigations by the petitioner in the Civil Court, High Court, this Commission and even the Supreme Court. It is not necessary for us to narrate various litigations started by the petitioner in order to avoid making payment as per the order of the State Commission. We do not find any error in the orders of the State Commission passed in execution proceedings taken by the State Commission in terms of the order dated 7.6.1994, this revision petition has no merit and it is dismissed with costs which we quantify at Rs. 5,000/-. Revision Petition dismissed with costs.
