The petitioner obtained 1.48 acres of land stated to be in Re. Sy. No.374/1 in Block No.28 of Ozhalapathi Village in Chittur Taluk as per Ext.P1 registered sale deed registered at the SRO, Kozhinjampara. Thereafter, the petitioner has been paying tax in respect of the property and was also issued with a possession certificate. When the petitioner approached the Village Office for measurement of the property, it was pointed out that the property of the petitioner is actually lying in Sy.No.373/1. The petitioner filed Ext.P5 representation before the 2nd respondent and Ext.P6 representation before the 3rd respondent with copy to the 1st respondent. The petitioner has approached this Court being aggrieved by the fact that through Ext.P7 communication from the Village Officer and Ex.P8 report of the Taluk Surveyor suggests that the petitioner should carry out a correction / rectification in Ext.P1 sale deed. It is the case of the petitioner that the mistake is in the Revenue Records and therefore, the matter needs to be considered by the competent among the respondents. The petitioner has also placed on record the title deed of the predecessor in interest of the petitioner, which also shows that the property which was purchased by the petitioner is in Old Sy. No.233/1, which corresponds to Re.Sy No.374/1, even going by Ext.P7.

Having heard the learned counsel for the petitioner and the learned Senior Government Pleader appearing for the respondents, this writ petition will stand disposed of directing the 2nd respondent to consider the request made by the petitioner in Ext.P5, after referring to the Survey / Re-survey Records as also the prior title deeds of the petitioner and after affording an opportunity of hearing to the petitioner. The needful shall be done by the 2nd respondent within a period of three months from the date of receipt of a certified copy of this judgment.

The writ petition will stand disposed of as above.
