Learned counsel for the petitioner submits that the only surviving grievance of the petitioner is with regard to non counting of the adhoc services which stood rendered by her for the purpose of grant of pensionary benefits.
In my considered view, taking into consideration the directions which were passed by the learned Tribunal in the earlier Original Application filed by the petitioner, she shall have to agitate this issue afresh by way of appropriate proceedings and this issue cannot be decided in this execution petition.
At this stage, learned counsel for the petitioner submits that the petitioner may be granted liberty to approach the Court afresh on this count and filing of the earlier petition and adjudication upon the same may not be treated as resjudicata. Ordered accordingly.
With these observations, this execution petition is closed, with liberty, as prayed for. Pending miscellaneous applications, if any, also stand disposed of.
