The present Civil Revision has been filed under Section 115 of the Code of Civil Procedure, 1908, against the order dated 03.08.2022, passed by the learned Senior Civil Judge, Dehradun in Original Suit No.302 of 2022, “Smt. Khushnuda Begum and Another vs. Smt. Meera Gupta and Others”, whereby, the application, filed on behalf of the revisionists – defendants for withdrawal of consent in regard to maintaining status quo, has been rejected.

Heard Mr. Siddhartha Singh, learned counsel for the revisionists – defendants and Mr. I.P. Kohli, learned counsel for the respondents – plaintiffs.

Mr. Siddhartha Singh, the learned counsel for the revisionists – defendants, submitted that the present revision may be decided directing the court concerned to decide the application for temporary injunction, filed by the respondents – plaintiffs, within four weeks.

Learned counsel appearing for the respondents – plaintiffs is also agree.

In the facts and circumstances of this case, and with the consent of learned counsel for the parties, the present Civil Revision (No.77 of 2022) is being disposed of directing the Trial Court to decide the Temporary Injunction Application, filed by the respondents – plaintiffs, on its own merit, within four weeks from the date of receipt of the certified copy of this order.

Till disposal of the Temporary Injunction Application, filed by the respondents – plaintiffs, both the parties are directed to maintain status quo on the property-in-dispute.
