Crl.M. No. 38459 of 2010

The present application u/s 482 Cr.PC has been filed to place on record Annexures P8 and P9 i.e. compromise arrived at between the parties and affidavit duly sworn by petitioner owning up the compromise. Further prayer is to permit the petitioner to withdraw main Crl.M. No. M-36622 in view of the compromise between the parties.

Crl.M. No. M-36622 was filed by petitioner-Meenakshi Sharma for issuing directions to respondents 2 to 4 (police authorities), to conduct a fair and proper investigation into her representations dated 11.7.2009 (PI) and 18.7.2009(P2) and register a case against private respondents 5 to 8.

At the time of hearing on 23.7.2010, leaned counsel for the petitioner on instructions from the latter stated that she and respondents had entered into a compromise whereby respondents had undertaken to withdraw all the cases filed by them against the petitioner and her family members and in return the petitioner had also agreed to withdraw all the cases filed by her against them. Accordingly, both the parties were directed to file their respective affidavits with regard to action taken by them in terms of the alleged compromise.

Now vide Compromise Deed dated 18.5.2010 (P- 8) both the parties have agreed to withdraw all the cases filed by them against each other and not to pursue the said criminal cases/complaints. Vide affidavit dated 27.7.2010, complainant Meenakshi Sharma, has stated that the mater between her and private respondents has been amicably settled and she no longer wishes to pursue the matter.

Learned Counsel for private respondents 5 to 8, on instructions, undertakes to abide by the terms and conditions of the compromise (Annexure P8). Learned State counsel states that he has no objection if the parties are permitted to act in accordance with the compromise and withdraw cases filed by them against each other including Crl.M. No. M-36622/2009.

In view of the compromise deed (Annexure P8), Affidavit dated 27.7.2010 (P9) of the petitioner and stand taken by the learned Counsel for the parties, Crl.M. No. 38459 of 2010 is allowed and the Crl.M. No. M-36622 of 2009, filed by the petitioner is dismissed as withdrawn.
