Judgment
Alok Kumar Verma, J
The present Appeal under Section 173 of the Motor Vehicles Act, 1988 has been filed by the claimants to enhance the amount awarded by the Motor Accident Claims Tribunal / Additional District Judge/IInd F.T.C. Udham Singh Nagar in Motor Accident Claim Petition No.190 of 2009. The learned Tribunal has awarded a total sum of Rs. 6,32,000/- (Rupees Six Lakh Thirty Two Thousand) as compensation along with an interest at the rate of 6% per annum from the date of petition till its actual payment.
Heard Mr. Basant Singh, learned counsel holding brief of Mr. Harshpal Sekhon, learned counsel for the appellants, Mr. Bharat Tewari, learned counsel for respondent no.1-Insurance Company and Mr. Pratiroop Pandey, learned counsel for respondent no.4.
There is no representation on behalf of respondent no. 2 and respondent no.3.
Mr. Basant Singh, Advocate submitted that the present Appeal has been filed only on the ground that the Tribunal has not considered the salary certificate of the deceased, filed by the claimants. As per the salary certificate, the salary of the deceased was Rs.8,500/- (Rupees Eight Thousand Five Hundred) per month. However, Mr. Basant Singh, learned counsel for the appellants, has conceded that the salary certificate has not been proved in accordance with law.
In view of the above, no interference of this Court is called for in the impugned judgment. The present appeal fails and deserves to be dismissed and is accordingly dismissed.
