Judgment
Sanjay Karol, J.—Mr. Verma submits that the impugned order of transfer stands modified and the petitioner is now adjusted/transferred to Govt. Sr. Secondary School, Indora, District Kangra, instead of Govt. Sr. Secondary School, Kufri, District Mandi to which place she was transferred from Govt. Sr. Secondary School, Galma.
Having perused the record, learned counsel for the petitioner, under instructions from the petitioner who is present in the Court, submits that petitioner shall make a detailed representation to respondent No. 1 within a period of two days from today. She shall point out all the hardships and difficulties, which she is likely to suffer on account of transfer from District Mandi to District Kangra. According to her, she is also medically undergoing treatment at Fortis Hospital, Chandigarh and District Hospital, M andi. Also she can be accommodated at another suitable place in District Mandi. Posting of an employee is the sole prerogative of the employer. However, we are sure that all these aspects shall be dispassionately looked into by the first respondent, who shall take a decision, keeping in view the position of law, equity and justice within a period of two weeks from the date of receipt of her representation. Till then, it shall be open for the petitioner to avail leave of the kind due.
