The original petition is filed to direct the Court of the Subordinate Judge-I, Thiruvananthapuram, to consider and dispose of Exts P10 to P15 applications, expeditiously.
Pursuant to the order dated 2.8.2023 passed by this Court, the learned Principal Subordinate Judge, by communication dated 10.8.2023, has informed this Court that the above applications have been filed. The respondent has entered appearance in the applications. The court below requires two months’ time to dispose of the applications.
Heard; Sri.Vinod.B, the learned counsel appearing for the petitioners. Even though notice has been served on the learned counsel appearing for the respondent before the court below, there is no appearance for him.
Having considered the pleadings and materials on record and after perusing the communication of the learned Principal Subordinate Judge, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I am inclined to allow the original petition.
Resultantly, I order the original petition as follows:
The Court of the Principal Subordinate Judge, Thiruvananthapuram, is directed to consider and dispose of Exts P10 to P15 applications, in accordance with law and as expeditiously as possible, at any rate, within a period of two months from the date of receipt of a certified copy of the judgment, after affording the parties an opportunity of being heard.
The original petition is ordered accordingly.
