Judgment
S. Siri Jagan, J.—The petitioner''s late father was receiving pension under the Swatantratha Sainik Samman Pension Scheme. After his death, the petitioner''s mother was receiving pension. On 24.8.2005, the petitioner''s mother expired. According to the petitioner, as per the Scheme, the petitioner being an unwed and unemployed daughter of a freedom fighter, she is entitled to continued payment of pension under the SSS Pension Scheme, which was hitherto being paid to her father and later her mother, who are no more. The petitioner''s grievance in this writ petition is that the same is not being paid to her.
The learned Assistant Solicitor General has today placed before me copy of a letter written by the Deputy Secretary to the Government of India to the Manager, State Bank of Travancore, which reads thus:
Ms. Mempath Savithri, unmarried and unemployed daughter of late Shri K.V. Sankaran Nair and late Smt. M. Kamalakshi Amma has filed the aforesaid Writ petition in the Hon''ble High Court of Kerala for grant of family pension and reported that her late father and mother who were drawing Freedom Fighters Pension from your office had expired on 15.8.1976 and 24.8.2005 respectively and has requested for grant of dependent family pension in her name. She has also submitted her formal application addressed to you alongwith the necessary documents.
As per the liberalized procedure contained in the letter No:8/17/89-FF(P) dated 1.5.1992 (Copy enclosed), the pension disbursing authorities are competent to commence payment of family pension to the eligible dependents after satisfying and ascertaining the veracity of the claim. It is therefore, requested that necessary action for payment of family pension in this case may please be taken in accordance with these instructions. Action taken in the matter may please be intimated.
In view of the said letter, nothing further needs to be done except to direct the bank to act in accordance with the above said letter. Therefore, there would be a direction to the 4th respondent- bank to act in accordance with the above said letter, as expeditiously as possible, at any rate, within two weeks from the date of receipt of a certified copy of this judgment.
