By way of instant contempt petition filed Art. 215 of the Constitution of India, prayer has been made on behalf of petitioner for initiation of
contempt petition against respondent for having willfully disobeyed the directions contained in judgment dated 24.4.2021 and order dated 30.4.2021
passed by Division Bench of this Court, in CWP No. 2611 of 2021, whereby Division Bench, while disposing of the petition, directed the respondents
to decide the case of petitioner in light of judgment dated 29.2.2020 rendered by Hon'ble Division Bench in Reckitt Benckiser (India) Private Limited
vs. State of Himachal Pradesh and another, AIR 2020 (HP) 86.
Since the respondents failed to take action in terms of the aforesaid directions issued by Division Bench of this court, petitioner has approached this
court in the instant proceedings. .
Shri Abhishek Sethi, Advocate, states that though after filing of the petition, opportunity of hearing was granted to the petitioner in terms of the
judgment alleged to have been violated, but no order has been passed till date.
Mr. Sudhir Bhatnagar, learned Additional Advocate General undertakes before this court, that necessary decision/order in terms of judgment
alleged to have been violated, shall be positively taken/passed within a week.
In view of above, nothing remains to be adjudicated in the present proceedings and same are closed. Notice issued to the respondent is discharged.
Petitioner shall be at liberty to get the present petition revived, in case, needful is not done by the respondent, within one week.
Petition stands disposed of in the afore terms.
