Heard learned counsel for the parties.
The petitioner named above has been made accused in connection with Sahibganj (M) P.S. Case No. 81 of 2022 for the offence under Section 395 of the Indian Penal Code, pending in the court of A.C.J.M., Sahibganj.
As per the prosecution case, dacoity was committed in Mahadeoganj Construction site at night wherein the informant was surrounded by about 10 to 11 persons and the iron rod etc. was looted away and threat to life was also extended.
It is submitted by learned counsel for the petitioner that there is no material against the petitioner except the confessional statement of the co-accused. There is no seizure of the looted articles from the petitioner. The petitioner has got no criminal antecedent.
Learned counsel for the State has opposed the prayer for bail but has not disputed the factual aspect.
Considering the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.50,000/-(Rupees Fifty Thousand) with two sureties of the like amount each, to the satisfaction of learned Court below.
