Md. Nasimuddin Ansari, S/o Late M.B. Ansari vs The Union of India represented by the Secretary, Ministry of Road Transport and Highway, Border Road Development Board, & Ors.

By way of the present petition, the petitioner seeks quashing of entry of the Interim Confidential Report from 16th December, 2005 to 31st

March, 2006 and 1st April, 2006 to 22nd September, 2006. The petitioner also seeks setting aside and quashing of impugned order dated 22nd

September, 2008, Signal dated 10th October, 2008 as well as rejection order dated 9th January, 2009.

During the course of arguments, Mr. R. Jha, learned counsel for the petitioner submits that the petitioner does not want to pursue the present

petition and seeks permission to withdraw the present petition with liberty to file a fresh petition, if occasion so arises. He has also moved an

application for withdrawal of the present petition with liberty to file a fresh, which is taken on record.

Mr. R. Debnath, learned counsel for the respondents submits that he has no objection to the submissions made by learned counsel for the

petitioner.

In view of the facts and circumstances of the case and submissions made by learned counsel for the parties as well as the application for

withdrawal of the writ petition, the present petition is dismissed as withdrawn with the liberty aforesaid.

The writ petition stands disposed of.
