Judgment
Heard Shri A.R. Bhuyan, learned counsel for the petitioner namely, Md. Jamal Uddin, who has filed this anticipatory bail application under Section 438
Cr.P.C. praying for grant of pre-arrest bail in connection with Murajhar Police Station Case No.491/2020 registered under Section
341/395/307/427/325 of the IPC, read with Section 25(1-A)/27(2) of the Arms Act.
Shri Bhuyan, learned counsel submits that the petitioner is not named in the FIR and only out of suspicion the police is looking for him.
On the other hand, Mr. T.K. Mishra, learned Addl. Public Prosecutor, Assam submits that apart from the offences and allegations which are serious
in nature, the involvement of the petitioner is apparent in the Case Diary. A perusal of the FIR dated 15.11.2020 indicates that the allegations are of
grave nature which involves dacoity and attempt to murder.
In view of the above, this Court is of the view that the present is not a fit case for exercising its discretion for granting privilege of anticipatory bail.
Accordingly, the same is rejected at this stage.
The pre-arrest bail application stands disposed of.
