This writ petition is filed questioning the action of the respondents in trying to demolish the petitioner’s house bearing No.14-1-129/28/734 situated at Padmavathi Nagar, Allapur, Kukatpally Mandal, Medchal-Malkajgiri District without following due process of law, as illegal and arbitrary.

Heard Mr. Jakkula Sridhar, learned counsel for the petitioner and Mr. Sampath Prabhakar Reddy, learned standing counsel for GHMC appearing for respondents.

Learned counsel for the petitioner submits that the respondents are interfering in petitioner’s peaceful possession and enjoyment in respect of the subject property without following the due process of law. Hence, the petitioner has approached before this court.

Learned standing counsel submits that even according to the petitioner, he has purchased the subject property by way of Agreement of sale and his vendor also purchased the same by way of Agreement of sale. He further submits that not only the petitioner, several people have constructed the houses in FTL land and when they want to serve the notices, they are not accepting the said notices.

In response to the same, learned counsel for the petitioner submits that the said notice may be served on him and the petitioner will submit his explanation to the same.

In view of the above, the petitioner shall submit his explanation within a period of seven (7) days from the date of receipt of copy of the order and the respondents shall consider the explanation and take appropriate action in accordance with law. If the petitioner fails to submit his explanation, the respondents are at liberty to take appropriate steps. Till such time, the petitioner also shall not make any further construction.

Accordingly, the writ petition is disposed of. No order as to costs.

Miscellaneous petitions, if any pending in this writ petition shall stand closed.
