Judgment
Hearing of this criminal revision petition has been convened and conducted through Video-Conferencing.
Mr. A.K. Sahani, the learned counsel appears for the petitioner and contends that the case filed by O.P. No.2, wife of the petitioner, alleging
harassment and torture has failed and while so, it must be concluded that O.P. No.2 has no reasonable excuse for not staying in the company of her
husband. The learned counsel further submits that the petitioner is still ready to keep his wife in the matrimonial home and provide all necessities of
life.
Mr. H.P. Singh and Mr. Azeemuddin, the learned APPs appear for the State. They have submitted that the order dated 24.11.2015 passed in
Original Maintenance Case No.50 of 2014 is an interim order and therefore the present criminal revision petition is not maintainable.
O.P. No.2 has put her appearance through Mr. N.K. Chatterjee, the learned counsel, who however has not joined the proceeding.
Mr. A.K. Sahani, the learned counsel for the petitioner, after arguing for some time, seeks permission to withdraw this criminal revision petition with
liberty to the petitioner to place on record the judgment in the criminal case and raise all such pleas which are available to him in law in the final
hearing of proceeding in Original Maintenance Case No.50 of 2014.
Accordingly, Cr. Rev. No.13 of 2016 is dismissed as withdrawn with the aforesaid liberty reserved with the petitioner.
