Judgment
Heard Ms. Ayangleima, learned counsel appearing for the petitioner and Mr. Niranjan Sanasam, learned GA for the respondents.
According to the petitioner, he is a Special Class Government Contractor. The Chief Engineer, RED, MSRRDA, Govt. of Manipur issued an NIT
dated 27.06.2020 in respect of various packages of works under PMGSY scheme. The petitioner being eligible, applied for it and submitted his bids in
respect of 2 packages, namely, MN03257 A (Construction of Bailey bridge over Phailen Lok on the road from Khanpi to Chingmei Kabui) and
MN03257 B (Construction of Bailey                                 Â
Bridge over Pahilen River on the road from Khanpi to Chingmei Kabui). The technical bids were opened on 17.07.2020 for which the bid evaluation
report dated 16.09.2020 was uploaded on 17.09.2020. On perusal of the said technical bid evaluation report, the petitioner found that his bids had been
rejected on the ground of “incomplete documents supporting the Balance Sheet Profit and Loss for all the Financial Yearsâ€.
Being aggrieved by the said report, the instant writ petition has been filed by the petitioner praying for quashing it.
When the matter was taken up for consideration on 28.01.2021, this Court issued notice to the respondents and on 29.01.2021, in view of the rival
contention, this Court was of the view that the export opinion would be required to verify whether the Technical bids submitted by the petitioner were
complete or not.
List the matter on 05.03.2021.
In the meantime, Registry is directed to send the copies of the documents at Annexure-A/5 to the office of the Accountant General, Manipur seeking
their views, along with the copies of the NIT and Tender Bidding Documents to be supplied by Ms. Ayangleima, learned counsel appearing for the
petitioner by tomorrow, i.e. 19.02.2021.
The Office of the Accountant General, Manipur is requested to get these documents examined by one of its officers and to submit a report to this
Court before the next date on the issue whether the documents, namely, Annexure-A/5 (Balance Sheets) can be said to be complete documents in
terms of the Tender Bidding Documents.
Copies of this order shall be sent to the learned counsels appearing for the parties through their WhatsApp/e-mail.
