Judgment
Since the parties in both the writ petitions are somewhat common, therefore, both the writ petitions are being disposed of by a common order.
WPA 18656 of 2026 has been filed by one Maya Singh praying for electricity connection at her residential premises. WBSEDCL is, in principle, ready and willing to effect electricity supply but it has not been able to do so in view of the objection raised by the respondent nos. 6 to 9. The respondent no. 6 in WPA 18656 of 2026 is the writ petitioner in WPA 20834 of 2026.
The writ petitioner in WPA 20834 of 2026 has also approached this Court with a similar grievance and here again, the WBSEDCL authorities are ready and willing to effect supply but they could not do so in view of the objection raised by the respondent nos. 6 and 7 in the said writ petition. The respondent no. 7 in WPA 20834 of 2026 is the husband of the writ petitioner in WPA 18656 of 2026.
It thus reveals that there are cross objections as regards supply of electricity to the petitioners of both this writ petitions.
By an earlier order passed by this Court in the two writ petitions, an inspection was conducted by the WBSEDCL in presence of all the parties to the two writ petitions however, WBSEDCL has not been able to come to a conclusion as regards an alternative route along which electricity line can be carried to both the writ petitioners thereby obviating the objections raised by the private respondents in both the writ petitions.
Since the only impediment in effecting electricity supply to the petitioners is non availability of alternative route/way leave, the same, in the opinion of this Court must be resolved by the appropriate authority under the Works of Licensee Rules 2006.
In terms of the Rule 3 thereof, the District Magistrate of the relevant District is one such authority.
Accordingly, the petitioners of both these writ petitions (i.e. Maya Singh and Smt. Kalpana Bakshi) are granted liberty to approach the District Magistrate, South 24-Parganas with appropriate representations detailing their grievances.
If such representation(s) is (are) made, the said District Magistrate shall consider and dispose of the same, in accordance with law after drawing appropriate proceedings, conducting inspection (or causing the same to be conducted) and hearing all the parties.
It is made clear that the inspection that would be caused to be conducted (or conducted) by the District Magistrate shall take place in presence of all the parties and all the parties would have opportunity to indicate the alternative route that will be considered by the District Magistrate. Copies of the inspection report shall be supplied to all the parties and all of them would be entitled to take exception thereto.
The District Magistrate shall upon considering the material before it and the case stated by all the parties would take appropriate decision within a period of eight weeks from the date of making of the representation(s). Needless to mention that the District Magistrate shall pass a reasoned order and communicate the same to the parties within a week from the passing thereof.
The District Magistrate shall fix a time within which, electricity would be effected in favour of the two writ petitioners through the alternative route fixed by the District Magistrate, upon decision in such regard being taken by the District Magistrate.
With the above observations, WPA 18656 of 2026 and WPA 20834 of 2026 stands disposed of. No Costs.
CAN 1 of 2026 has been filed by one Sanjib Mondal who seeks to be added as a party to WPA 18656 of 2026. It is submitted that he might be effected by erection of pole on his land. Since WPA 18656 of 2026 has been disposed as above there is no scope for addition of party however, the applicant of CAN 1 of 2026 shall also be free to approach the District Magistrate in the same proceedings that would be drawn up upon the writ petitioner of WPA 18656 of 2026 making her representation. The said writ petitioner may inform the applicant about the representation made by her before the District Magistrate for facilitating the participation.
