Dharam Veer, J.—Heard Mr. Abdul Wahid, Advocate for the applicant and Mr. Amit Bhatt, Addl. G.A. for the State.

Learned Counsel for the applicant argued that the applicant has been implicated in the above said case only due to the reason that he is the brother in law of Kailash, against whom the allegation is that he took the victim Vinita Joshi by enticing her from her house. Further, the victim is a major and the applicant has no connection whatsoever with the above said incident and even he dos not know where the victim and accused Kailash have gone. Further co-accused Bharbhaju, Smt. Sushila Kaushab, Ramwati and Smt. Veero Devi have been granted bail by the Sessions Judge, Pauri on 23.7.2010 and the applicant also deserves bail on the basis of parity.

After considering all the facts and circumstances, perusing the contents of the FIR and other papers available on record, without expressing any opinion about the final merits of the case, the Court is of the view that the present applicant deserves bail at this stage.

Let the applicant be released on bail on executing a personal bond and furnishing two sureties each in the like amount to the satisfaction of CJM, Pauri Garhwal.

The bail application is allowed accordingly.
