Respondent no.1appellant aggrieved by the order dated 9th October 2009 passed by the learned Single Judge in the writ petition no. 52472 of 2009 has preferred this appeal under Rule 5 Chapter VIII of the High Court Rules.
Writ petitionerrespondent no. 1 aggrieved by the order dated 29th of August 2009 passed by the specialist Basic Education Officer, Ballia has preferred the writ application. By the said order, appointment of the writ petition was cancelled and appellant herein was recommended for appointment.
When the matter is taken up, Mr. B.N. Singh appearing on behalf of the appellant submits that appellant has no objection to the quashing of the order dated 29.8.2009 impugned in the writ petition.
With the consent of the parties order dated 29.8.2009 is quashed and the matter is remitted back to the Specialist Basic Education Officer, Ballia. Counsel for the appellant as also respondent no. 1 state that they shall be appear before specialist Basic Education Officer, Ballia on 4th January 2010. The Basic Education Officer, Ballia shall take the final decision within 4 weeks thereafter and pass a fresh order hearing the appellant as also respondent no. 1.
Writ petition no. 52472 of 2009 as also this appeal stand disposed of accordingly.
