The application is filed under Section 438 of the Code of Criminal Procedure, 1973, for an order of pre-arrest bail.
The petitioners are the accused 1 and 2 in crime No.763/2023 of the Aroor Police Station.
When the bail application came up for consideration on 21.11.2023, in the light of the submission made by the learned Public Prosecutor that the custodial interrogation of the petitioners was not necessary and they need only to cooperate with the Investigating Officer, this Court directed the petitioners to surrender before the Investigating Officer within a period of three weeks from the date of the order and subject themselves for interrogation, and in the event of their arrest, they should be released on bail.
Heard; Sri.C.A Chacko, the learned counsel appearing for the petitioners and Smt.Neema T.V, the learned Public Prosecutor appearing for the respondent.
The learned Public prosecutor, on instructions, submitted that pursuant to the order dated 21.11.2023 the petitioners had surrendered before the Investigating Officer and were interrogated. They have also executed bonds with two solvent sureties each to the satisfaction of the Investigating Officer. Therefore, the petitioners’ further presence is not necessary, at present. The said submission is recorded.
Resultantly, the bail application is disposed of making the interim order absolute.
