NONE present either for the complainant or for the opposite party. The complaint was filed on 8.9.1994 and notice was issued to opposite party who have received the notice as is clear from the acknowledgement receipt and the office note dated 8.5.1998. We have perused the complaint petition. The grievance of the complainant is that he gave the opposite party-Press to print his book with title as ''Scattered Leaves'' some time back in the year 1990. The opposite party kept the manuscript and did not print the book. In the process of the following for the printing work by the opposite party, the complainant alleges to have sustained loss and also suffered mental agony. Admittedly the opposite party did not contest the case. They have not challenged the allegations in the complaint petition. In the absence of the counter/objection from the opposite party, we have no hesitation to hold that the allegation of the complaint petition are true that the complainant had delivered to the opposite party for printing the book which the opposite party did not do. We allow the C.D. Case directing the opposite party Promode Das, Director, Amarjyoti India (Press), Makarbag, Dargabazar, Cuttack to publish the book of the complainant ''Scattered Leaves'' at the present cost to be paid by the complainant within a period of three months. If for any reason the opposite party is unable to print he shall pay Rs. 5,000/- as compensation for mental agony suffered by the complainant, within a period of three months thereafter. Complaint disposed of.
