Heard Mr. J. Shylla, learned counsel for the petitioner.
Issue notice.
At the outset, Mr. J. Shylla, learned counsel for the petitioner prays that this matter may be taken up under Article 226 of the Constitution of India, though Article 227 has also been mentioned in the Cause Title.
The learned counsel submits that the challenge is to the endorsement of a Title Suit being T.S. No. 1 of 2025 and Misc. Case No. 4 of 2025, to the Court of Civil Judge, (Senior Division), East Jaintia Hills District, for disposal. Learned counsel contends that till date, there has been no statutory conferment of powers upon the said Court of Civil Judge (Civil Division), and as such, the Court is incompetent to take up the matter. He prays in this backdrop that the proceedings in the Title Suit and the Misc. Case be stayed for the time being.
I have heard the learned counsel for the petitioner and also examined the order dated 10.07.2025, whereby the Title Suit and the Misc. Case has been endorsed to the Court of Shri. A.W. Lanong, Civil Judge (Senior Division), for disposal.
As the matter concerns the administration of justice and conferment of powers, apart from the respondents arrayed herein, notice to issue to the Learned Advocate General within three days.
List this matter on 10th November, 2025.
In the interim, it is provided that status quo shall be maintained of the suit land, in question and the proceedings of the Title Suit and the Misc. Case shall also remain stayed.
