The prayer made in this application filed under Section 439 of the Code of Criminal Procedure (for short "the Code") is for grant of interim bail in connection with crime registered pursuant to First Information Report No.552/2021 of Police Station Hanumangarh Junction, District Hanumangarh in respect of offence(s) punishable under Section(s) 363, 366, 376(2)(n), 376(3) of the Indian Penal Code, 1860 and 3/4(2), 5(L)/6 of POCSO Act for a period of 15 days.
Heard the arguments advanced by learned counsel for the petitioner, learned public prosecutor, learned counsel for the complainant and carefully perused the entire material available in case diary.
Per contra, learned Public Prosecutor has submitted a factual report and opposed the interim bail application filed by the petitioner.
The factual report submitted by the learned Public Prosecutor is taken on record.
In view submissions made and factual report submitted by learned Public Prosecutor, the petitioner is said to be brother of Nirmal Singh whose marriage is to perform on 21.06.2023. Looking to the facts and circumstances, this Court is not inclined to grant the present misc. interim bail application to the petitioner.
Accordingly, the present misc. interim bail application is dismissed.
