Om Prakash, J.—Heard counsel for the parties.

Whereas petitioner No. J is the Principal of Madarsa Islamiyan Jamiaytul Quresh which is said to have situated at present in mohalla Jalindhri, Azamgarh, petitioners No. 2, 3 and 4 are Assistant Teachers in alia grade.

The contention of the petitioners is that the writ petition was filed as the respondents stopped ''making payment of salary. By an order dated 1331985, half salary from 1981 to 1984 was paid to the petitioners and onwards the petitioners received full salary as and when that fell due under the said orders of the Court.

Learned standing counsel submits before us that the payment of salary was stopped because recognition of the Institution was withdrawn under the orders of the Additional Director of Education, Allahabad. The standing counsel states that recognition has been given to the Institution again and the petitioners are accordingly paid salary.

No Explanation has been given in the counter, affidavit by the State Government as to why the balance amount of salary was not paid to the petitioners for the period from 1981 to 1984.

On these facts the petition is disposed of finally directing the respondents to pay the balance amount of the salary relating to the period

1981 to 1984 if not already paid within 6 weeks from the date a certified copy of this order is presented to them by the petitioners and they are further directed to continue to pay future salary in accordance with
