The petitioner has filed the present petition under Section 482 of B.N.S.S (Section 438 of Cr.P.C) with a prayer to grant anticipatory bail to him in case FIR No.81, dated 15.04.2026, under Sections 318(4), 316 of B.N.S (Sections 420, 406 of IPC), registered at Police Station Bhawanigarh, District Sangrur, Punjab (Annexure P-1).

While granting the concession of interim anticipatory bail by this Court on 21.07.2026, the following contentions were noticed by this Court and the same have been reproduced below:-

“Learned counsel for the petitioner contends that the petitioner and his wife managing a firm under the name and style of M/s Visa Advise Bureau, Sector-17, Chandigarh and providing the necessary assistance and professional services for planning and execution of immigration services to the general public and a valid license dated 29.08.2023 (Annexure P-2) has been issued in their favour. Learned counsel next submits that in November, 2023, Jashanpreet Kaur and her husband approached the petitioner for availing their services for securing couple visa to U.S.A. During the said process, the training was also imparted to the couple for getting them ready for the visa interview and personality development. Learned counsel referred to the detailed submissions mentioned in the petition to contend that a sum of Rs.6,48,000/- was spent by the firm of the petitioner on various paper formalities. However, despite all preparations, Jashanpreet Kaur could not qualify the interview for securing the visa for couple and file of the complainant and her husband was closed. Apart from that, the husband of Jashanpreet Kaur also submitted an affidavit dated 24.01.2025 to the effect that the petitioner had completed all formalities and there was no liability on the part of the petitioner and the expenses were incurred on the process for getting the visa for the couple. Learned counsel further submits that after a period of three months, the family members of the complainant started threatening the petitioner and ultimately, got a false F.I.R registered by concocting a false story against the petitioner.”

Learned counsel for the petitioner has reiterated the submissions and further submits that the petitioner has joined the investigation and his custodial interrogation may not be required.

In compliance of order dated 21.07.2026 passed by this Court, status report by way of an affidavit of Deputy Superintendent of Police, Sub-Division Bhawanigarh, District Sangrur has been filed by learned State counsel in Court today and the same is taken on record. Learned State counsel submits that the petitioner has joined the investigation and is no longer required for further investigation.

In view of the statement made by learned counsel for the parties, the present petition is allowed and the interim order dated 21.07.2026, passed by this Court is made absolute. The petitioner shall continue to join investigation, as and when called by the Investigating Officer and shall also abide by the conditions as provided under Section 482(2) of the BNSS.
