The applicant is a lady, who is seeking regular bail in relation to FIR No. 152 of 2023, for the offences cognizable under Sections 304/34 of IPC, registered at Bajpur, District - Udham Singh Nagar.

Learned counsel for the applicant submits that the present applicant is a lady having three minor children and she is languishing in jail since 03.11.2023.

Learned counsel for the applicant further submits that the other co-accused have been enlarged on bail by this Court by order dated 12.09.2023, passed in BA1 No.1018 of 2023 and BA1 No.1445 of 2023. Learned counsel for the applicant submits that the present applicant is claiming parity as given to the other co-accused persons.

This fact has also not been disputed by the State Counsel that it is a case of parity. The State Counsel fairly submits that the present applicant is entitled to the benefit of parity, since the other co-accused, have already been enlarged on bail by this Court.

The present applicant is in jail since 03.11.2023, and furthermore, taking into consideration that other co-accused have already been enlarged on bail by this Court thus without expressing any opinion on the merit of this case, this Court is of the view that this it is a fit case for grant of bail.

The Bail Application is allowed.

Let the applicant-Manpreet Kaur be enlarged on bail on her furnishing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the Court concerned.
