Issue notice to the respondents on payment of P.F. within one week returnable in four weeks. Even though the matter pertains to appointment of Gram Rojgar Sahayak and the petitioner has a remedy of filing an appeal but considering the manner in which selection process has been conducted in this case, it is thought appropriate to call for the reply from the respondents.
Records indicate that the Collector of the District concerned constituted a five member Selection Committee for conducting a process of selection. The said committee conducted the process of selection and published the select list Annexure P/2 in which the name of the petitioner was kept in Srl. No. 1 having received total 70% marks available in Annexure P/2 is signed by all the five members who was nominated by the Collector. Surprisingly, respondent No. 7 seems to have been appointed on the basis of select list Annexure P/1 issued subsequently which is signed only by the Project Officer, MGNREGS, Janpad Panchayat, Panagar and in this the name of the petitioner has been relegated to Srl. No. 2 and entire merit list prepared by five members has been changed. It is not known as to how and on what circumstances the list has been changed.
Keeping in view the aforesaid, I do not deem it appropriate to relegate the petitioner to take recourse to the alternate remedy. Respondents to show cause as to why prayer made by the petitioner be not allowed.
Till the next date of listing no appointment in pursuance to Annexure P/1 Select list shall be made. c.c. as per rules.
