Heard learned counsel for the applicant and learned A.P.P. for the State.

This bail application has been filed on behalf of the abovenamed applicant with prayer to release on bail in connection with Bashistanagar P.S. Case No.36 of 2021, registered under Section 392 of the Indian Penal Code pending in the court of learned Chief Judicial Magistrate, Chatra.

The learned counsel for the applicant has submitted that the FIR was lodged by the informant, namely, Deepak Kumar Sharma against the unknown persons with the police station concerned with these allegations that he was Director of CSP Centre, Ghanghari. On 09.04.2021 in the morning at 9:30 am, he left his house for the CSP Centre, amid the way, three to four persons who were on two motorcycles intercepted him and looted the amount of Rs. 84,500/- in cash, two mobile phone, blank cheque book, pass book of the customers and another document.

It is further submitted that this FIR was lodged against the unknown persons, name of the applicant transpired during the investigation on his self confession in another case. No stolen property was recovered from the possession of the applicant. No TIP was conducted to identify the complicity of the applicant in commission of the alleged offence. Similarly situated co-accused, namely, Tuntun Paswan @ Tuntun Kumar has been granted bail in B.A. No.2480 of 2022 vide order dated 20.04.2022 by this Bench. The applicant has been languishing in jail since 28.09.2022 and the role of the applicant is identical to that of co-accused, who has been granted regular bail.

Learned A.P.P. appearing on behalf of the State vehemently opposed the contentions made by the learned counsel for the applicant.

In view of the submissions made and materials on record, the bail application of the applicant is hereby allowed. Let the applicant be released on bail on furnishing bail bond of Rs.20,000/-(Rupees Twenty Thousand) with two sureties of the like amount to the satisfaction of the court concerned in aforesaid case.
