Petitioners are seeking regular bail in FIR No. 89/2018, under Sections 420/406/120B IPC, registered at Economic Offences Wing, Delhi while seeking parity with accused- Praveen Popal and Khimji Bhai Jadeja. Both the petitioners were declared proclaimed offenders in the year 2010 and were arrested in the year 2019.

Learned counsel for the petitioners submits that Ashok Jadeja is the main accused who has allured the complainant and other persons to invest money by befooling them that with the blessings of 'Sikodi Mata" their money would be tripled.

Learned Additional Public Prosecutor for State opposes the application on the ground that similar complaints of 1852 victims of deceit were received who have been cheated by Ashok Jadeja who had constituted a body of promoters and agents for promoting the scheme and collecting money. Learned Additional Public Prosecutor for State further submits that if the petitioners are released on bail, there is every likelihood that they will tamper with the evidence and influence the witnesses.

I have given my thoughts to the matter. The accused persons were declared proclaimed offender in the year 2010 and were arrested in the year 2019. The allegations against them are that they were promoters and agents for promoting the scheme for collecting money by cheating the innocent persons, no grounds for bail are made out. The bail application is, therefore, dismissed.
