Umesh Chandra Dhyani, J.—Applicant, who is in jail in connection with Case Crime No. 74 of 2014, relating to offences punishable under Sections 452 and 354 of IPC and Section 8 of the Protection of Children form Sexual Offences Act, 2012, Police Station-Vikas Nagar, District Dehradun, has sought his release on bail.

Heard learned counsel for the parties, perused the material on record and considered the grounds taken up in the bail application.

A first information report was lodged against the applicant for the offences punishable under Sections 452 and 354 of IPC and Section 8 of the Protection of Children from Sexual Offences Act, 2012. The allegation against the applicant is that on 20.04.2014, when the informant''s daughter was all alone at her house, at 2:00 p.m., accused-applicant came to the house and flirted with her. Applicant has no previous criminal history and is in jail since 22.04.2014.

Considering the facts and attenuating circumstances, a case of bail is made out in favour of the applicant.

Accordingly, the bail application of the applicant is allowed. Let the applicant Manoj Kumar be released on bail on his executing a personal bond and furnishing two sureties, each of the like amount to the satisfaction of Additional Chief Judicial Magistrate/Judicial Magistrate, Vikas Nagar.
